These terms are an agreement between you and Modernize Marketing LLC (“we”, “us”) for the Flex Hydra desktop and phone apps, the Flex Hydra website and your Flex Hydra account (together, “Flex Hydra”). By creating an account or using Flex Hydra you agree to them.
Your account
You sign in with a code sent to your email address. Keep access to that inbox secure — anyone who can read it can sign in as you. You’re responsible for what happens under your account.
Subscriptions and billing
- Starting new sessions in Flex Hydra requires a license: an active subscription of your own, a seat in an active company (see Companies), or free access we’ve given you. There is no free trial.
- Subscriptions are billed monthly or yearly in advance and renew automatically until you cancel. Payments are processed by Stripe.
- Prices exclude taxes; applicable sales tax or VAT is added at checkout.
- You can cancel anytime. Cancelling stops the next renewal; you keep access until the end of the period you’ve paid for.
- If a payment fails we’ll retry it. If it still can’t be collected, the subscription ends.
- We may change prices with at least 30 days’ notice by email. A new price applies from your next renewal after the notice.
- Refunds are covered by our Refund Policy.
Your license
While you have a license we grant you a personal, non-exclusive, non-transferable license to use Flex Hydra on up to 3 computers at once. You may not resell or share your account, circumvent the license or device checks, or copy, modify or reverse engineer the app except where the law allows it.
Companies
A company is a shared space for a team in Flex Hydra, with chat, task boards, docs, time tracking and calls. Anyone with a subscription of their own, or free access, can create one company, and owns it. People join by invite, and can belong to several companies.
- The owner can do everything in the company, including its billing, making and removing admins, and deleting it. A company has one owner, and ownership can’t be transferred. The owner can’t leave the company, but can delete it.
- Admins invite and remove members, choose members’ settings (direct messages, their board, time tracking and hourly rate), and manage the company’s channels, boards, notebooks, approvals, time settings and payroll.
- Members chat, work on their boards and in docs, and track their own time.
Seats
- Every member of a company is a seat, the owner included. The owner’s subscription pays for every seat at the plan’s price: $37 a month or $370 a year per seat, before tax.
- The number of seats follows the members. When someone joins or leaves, the change is prorated and appears on the owner’s next invoice. Pending invites aren’t seats.
- A seat in an active company licenses its member to use Flex Hydra under these terms. A member who also pays for a subscription of their own can cancel it; they need one only to create a company of their own.
- A company whose owner has free access covers its members, with no seats to pay for.
When a company lapses
A company is active while its owner has a live subscription or free access. When the subscription ends, or the free access does, the company turns read-only: everything in it still opens, but nothing can be added or changed, except that people can leave or be removed and the owner can delete it. Its calls end, its running timers stop, and members without a license of their own can’t start new sessions until the owner renews. Sessions already running are never stopped. Renewing makes the company active again.
The owner’s responsibilities
- The owner is responsible for the company’s seats and their charges, and for how its members use Flex Hydra in the company.
- Time tracking with screenshots is the company’s choice, made by its owner and admins. Before it’s turned on for anyone, the owner is responsible for telling them what it records and who sees it, as our Privacy Policy describes, and for getting any consent the law where they work requires. We don’t give legal advice about what that is.
Invites
Owners and admins invite people by email; only the owner can invite admins. We send the invite email for you, so invite only people who expect to hear from you. An invite works only for the email address it was sent to, expires after 7 days, and can be revoked until it’s accepted. Accepting an invite makes you a member of the company in the role it names: its owner and admins can then see your profile and what you share there, and, if they turn time tracking on for you, your time records and screenshots.
Content in a company
What you post in a company (messages, files, tasks, comments and pages) stays yours or your company’s, as you and it agree. You give us permission to store it and show it to the people the company’s settings allow, only to run Flex Hydra. You’re responsible for having the right to post it. What members post stays with the company when they leave.
Deleting a company
The owner can delete the company at any time in the desktop app. That deletes everything in it, for every member and for good, and brings the owner’s subscription back to one seat. Deleting the owner’s account deletes their company too. What deleting a company or an account removes is set out in our Privacy Policy.
Free access
We may give free access to some accounts, at our discretion. It licenses Flex Hydra with no subscription, and a company its holder owns covers its members at no charge. We can end free access at any time; the holder’s company then turns read-only unless they subscribe.
Coding agents and other third-party tools
Flex Hydra runs command-line tools made by others — such as Claude Code, Codex, Grok Build, Gemini CLI and Cursor Agent — signed in with your own accounts with those providers. Your use of those tools and accounts is governed by their providers’ terms, which you’re responsible for following, and their usage counts against your plans with them. Flex Hydra is not affiliated with or endorsed by Anthropic, OpenAI, xAI, Google or Anysphere.
Coding agents run commands and change files on your computer. You decide what they’re allowed to do, and you’re responsible for reviewing their work and keeping backups.
Acceptable use
Don’t use Flex Hydra to break the law, to harm others, or to attack or overload our service or anyone else’s. In a company, don’t post what you don’t have the right to share, and don’t use invites to email people who haven’t asked to hear from you.
Updates and availability
Flex Hydra updates itself. We may stop supporting old versions, in which case the app asks you to update before starting new sessions. We work to keep the service available but don’t guarantee it will be uninterrupted.
Disclaimer
Flex Hydra is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We don’t warrant that it will be error-free or that the output of any coding agent will be correct.
Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental or consequential damages, or for lost data, profits or revenue. Our total liability for any claim is limited to what you paid us in the 12 months before the claim.
Ending the agreement
You can stop using Flex Hydra and ask us to delete your account at any time. We may suspend or end accounts that break these terms. Sections that by their nature should survive (such as the disclaimer and limitation of liability) survive the end of this agreement.
Changes to these terms
We may update these terms. We’ll post the new version here with its date. Continuing to use Flex Hydra after that means you accept them.
Governing law
These terms are governed by the laws of California, USA, except where the law of your country of residence says otherwise.
